Brosses Industrielles et Techniques Koti B.V. located at Celciusstraat 18, 6003 DG Weert, The Netherlands, is responsible for the processing of personal data as described in this privacy statement. Industrial and Technical Brushes In this document, Koti B.V. is referred to as the “controller”. The term “data subject” refers to any natural person whose personal data is processed by the processor.

1. General

This privacy statement describes how the processor and the operating companies belonging to its group process the personal data of its data subjects/categories of data subjects, e.g. (potential) customers, job applicants, business partners, suppliers, intermediaries.

2. Personal data

Personal data is information relating to an identified or identifiable natural person. The processor may process the following data of data subjects, because the data subject uses the processor’s services and/or because the data subject provides them himself:

  • First and last name
  • Address details
  • Phone number
  • E-mail address
  • IP address
  • Other personal data that you actively provide, for example by creating a profile on this website, by correspondence or by telephone.
  • Data relating to your browsing behavior on different websites (for example, because this company is part of an advertising network).
  • Internet browser and device type

The data controller collects personal data from a data subject in the following manner(s):

  • where the data subject has provided such personal data to the controller via the website;
  • the data subject contacts the subcontractor to request information about the subcontractor’s services or products;
  • by the data subject who places an order with the subcontractor; or
  • by being generated by the data subject’s use of the controller’s services or website, including through cookies; or
  • through third parties, such as recruitment agencies, for recruitment and selection purposes.

If the data subject is obliged to provide certain data, he or she will be informed of the possible consequences of not doing so. The data subject is never obliged to provide personal data. If the data subject refuses to provide personal data, the data controller may not be able to provide services. Our website and/or service does not intend to collect data from website visitors under the age of 16. Unless they have obtained the consent of their parent or guardian. However, we cannot verify whether a visitor is over 16. We therefore advise parents to be involved in their children’s online activities to avoid collecting data on children without their consent. 3. Purposes and basis for processing personal data

The controller processes the data subject’s personal data on a lawful basis under the General Data Protection Regulation :

  • b. Signature of an agreement with the person concerned
  • c. Meet a legal obligation
  • d. Performance of a task in the public interest
  • e. Legitimate interest of the processor or a third party

The processor processes certain personal data in the context of its legitimate interests. The subcontractor’s legitimate interests include marketing, advertising, research into its own products or services, IT management and security, and sharing with parties affiliated with the subcontractor. The controller processes personal data for the following purposes:

  • Sending of our newsletter and/or advertising brochure by the subcontractor ;
  • Offer products or services or maintain a relationship with a supplier, including providing customer service or technical assistance and handling requests related to products or services;
  • To establish and maintain a customer relationship with data subjects, for example to send information messages about products or services or to respond to data subjects’ questions and requests;
  • recruit staff, process applications received via the website or otherwise, select the candidate if necessary;
  • inform you of changes to our services and products;
  • Allow you to create an account ;
  • To provide targeted advertising based on the interests of the data subject, using cookies and similar technologies to collect relevant information about the data subject ;
  • To provide you with goods and services;
  • Ensure security (of IT systems), including data collected through the use of access badges and audio and visual data such as CCTV images or ;

4. Access to personal data and sharing with third parties

In principle, the processor does not provide personal data to other parties. However, it may do so if

  • personal data is provided to subcontractors engaged by the processor with whom a processing agreement has been concluded or to independent subcontractors, for example IT, hosting, human resources or other service providers, external consultants, accountants or lawyers
  • The controller is under a legal obligation to disclose personal data to competent authorities, such as regulators or other public authorities.
  • personal data is supplied to a company belonging to the subcontractor’s group or to another department within the subcontractor’s company.

Personal data will only be provided to the above-mentioned parties for the purposes indicated in this privacy statement and to the extent permitted by this privacy statement and applicable laws and regulations, or if the controller has a legal obligation to provide personal data to a competent authority. Parties to whom personal data is provided are themselves responsible for compliance with privacy laws. The controller is neither responsible nor liable for the processing of your personal data by these parties. In order to provide the services, the controller may be required to transfer personal data to countries outside the European Economic Area. In this case, the processor must put in place appropriate safeguards to legally transfer the personal data to these countries.

5. Cookies or similar techniques

The Processor uses so-called “cookies”. With these cookies, in accordance with the preferences specified by the Data Subject, the Processor automatically collects certain data about the Data Subject’s activity history on its website and on third-party websites and apps. Thus, the Data Subject’s personal data may be collected while the Data Subject is using the Processor’s website, other websites or apps or if they are running in the background on the Data Subject’s device. This data may be combined by the Processor with other data concerning the Data Subject’s device, such as an IP address. If this requires the Data Subject’s consent, the Processor will request it in advance. 6. Rights of persons concerned

  • The data subject has the right to access, rectify and delete his/her personal data in accordance with the provisions of the General Data Protection Regulation. The data subject also has the right to object to the processing of his/her personal data.
  • The data subject may request the processor to restrict processing and data portability. The latter means that the data subject has the right to receive the personal data that the processor holds about him or her in a structured, commonly used and machine-readable format and, if necessary, to have it transferred by the processor to another processor.
  • If the data subject has consented to the processing of his/her personal data, he/she has the right to withdraw this consent at any time.

7. Storage period

The processor retains personal data for a period of 12 months after the end of the services provided to the data subject, unless the processor is required by law to retain personal data for a longer period.

8. Changes to the privacy statement

  • The Controller reserves the right to modify this Privacy Statement. The controller will announce any such change in accordance with the law. Any changes will be announced on this page and clear notification will follow in the event of a material change to the privacy statement. The controller therefore advises the data subject to check this page regularly for changes.
  • If the data subject continues to use the subcontractor’s website and/or services after the changes have come into effect, this means that the data subject accepts the changes. If the data subject does not accept the changes, he or she must stop using the website and/or services.
